Because most breast cancers will show up on a mammogram before they are large enough to be felt during an exam, most malpractice cases occur when a radiologist fails to identify a suspicious mass or nodule. The typical case arises when a woman learns that she has breast cancer which has spread beyond the breast. The initial shock gives way to bewilderment that this could have happened despite annual screening mammograms. Shock gives way to questioning, the mammograms are obtained, and it is learned that one or two years before the diagnosis, a mammogram(s) showed a suspicious nodular density that should have been assessed by ultrasound and fine needle biopsy.

How can you protect yourself from a failure to diagnose breast cancer?

If you have dense breasts, which decrease the ability of mammograms to capture malignant masses, ask your doctor whether you should have a digital mammogram and whether you should add ultrasound to your screening. Also, try to go to a busy center where the radiologists concentrate on breast screening – the more mammograms a radiologist reads, the better able she or he will be in detecting cancers.
